("we" or "us") regarding the collection, use, and disclosure of personal data from users of the Bora Live Services, which includes our application, and service. We value the privacy of users, subscribers, publishers, members, and others who visit and use the Bora Live Services (collectively or individually, "you" or "users") and want you to be familiar with how we collect, use, and disclose personal information from and about you.

You may share personal information when using the Bora Live Services. One example is when you provide information about yourself as part of the account creation process. Another is when you take certain actions on the Bora Live Services that are public or intended to be public in nature, such as when post profile information. Given the social nature of some of the Bora Live Services, that information may be collected, used, or disclosed by others who are part of that social interaction. 1. What Information Do We Collect

1.1 Information collected when you use our services

For a better experience while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to your name, phone number, and postal address. The information that we collect will be used to contact or identify you.

When you create an account, upload content, contact us directly, or use the Platform in other ways, you may provide some or all of the following information:

• Account and profile details, including your name, age, username, password, language, email address, phone number, social media account information, and profile picture.

• User-generated content, which encompasses comments, photos, livestreams, audio recordings, videos, text, and virtual item videos that you opt to create or upload to the Platform ("User Content"), along with associated metadata like the time, location, and creator of the content. When you generate User Content, we may upload or import it to the Platform prior to you saving or posting it (referred to as pre-uploading). If you apply an effect to your User Content, we may collect a version of it that excludes the effect.

• Messages, containing the information you provide when composing, sending, or receiving messages via the Platform's messaging features. This includes the message content and details about the message, such as the time it was sent, received, or read, as well as the participants in the message. Please note that messages you choose to send to other Platform users will be accessible to those users, and we shall not be liable for how those users utilize or share such messages.

• Information from your device's clipboard, including text, images, and videos, but only with your permission. For example, if you decide to share information with a third-party platform or paste content from the clipboard onto the Platform, we will access the information stored in your clipboard to fulfill your request.

• Your Global Positioning System (GPS) information, but only after you grant us permission. You can modify the access to your GPS information through the settings on your mobile device.

• Payment details, such as your full name, billing address, billing zip code, billing country, date of birth, purchase amount, payment method, credit or debit card number, or other necessary payment information required for transactions.We will not retain and collect your credit card name, number or password, these payment information will be collected by the third-party payment channel as you choose.

• Transaction information, including the transaction serial number and transaction history, after you purchase Paid Services.

• If you contact our Customer Support team via customer service, we will receive your information, and may track your IP address as well as the information you send to us to help resolve your query. We will keep records of our communications with you, including any complaints that we receive from you about other users (and from other users about you).

• Information you share through surveys, or your participation in challenges, research, promotions, marketing campaigns, events, or contests, such as your gender, age, likeness, and preferences.

1.2 User-Approved Permissions

To provide full functionality, our app requires certain device permissions. These permissions require your explicit consent through system prompts:

• Camera Access (CAMERA): Required for video calls and live-streaming, activated via system prompt when first using video features.

• Microphone Access (RECORD_AUDIO): Enables audio during calls and streams, triggered by system prompt during first audio use.

• Photo Access (READ_EXTERNAL_STORAGE): Lets you attach chat images and set profile pictures; on Android 12 & below this requires a system prompt, while Android 13+ uses a built-in secure photo picker.

• Photo Storage (WRITE_EXTERNAL_STORAGE): Allows saving photos taken within the app; Android 12 & below requires permission prompt, while Android 13+ uses scoped storage without needing permission.

1.3 Automatic Permissions

These are granted during installation for core functions:

• INTERNET: Connects to our servers for all online features.

• AD_ID: Accesses Google Advertising ID for personalized ads (adjustable in device ad settings).

• BLUETOOTH: Detects and connects to wireless headsets.

• ACCESS_WI-FI_STATE: Checks Wi-Fi connection status.

• ACCESS_NETWORK_STATE: Monitors network availability to prevent data loss.

• READ_PHONE_STATE: Optimizes call performance by checking device capability.

• POST_NOTIFICATIONS: Delivers app alerts and notifications.

2. How We Use Your Information

The main reason we use your information is to deliver and improve our Services. Additionally, we use your info to help keep you safe. Read on for a more detailed explanation of the various reasons we use your information, together with practical examples.

2.1 Services Provision and Operation

For example, we retain traffic data and data about transactions in line with our accounting, tax and other statutory data retention obligations and to be able to respond to valid access requests from law enforcement. We also keep data evidencing consents members give us and decisions they may have taken to opt out of a given feature or processing.

• With service providers, sellers, and partners. We may share information about you with service providers who perform services on our behalf, sellers that provide goods through our services, and business partners that provide services and functionality.

• With third parties for legal reasons. We may share information about you if we reasonably believe that disclosing the information is needed to.

• Comply with any valid legal process, government request, or applicable law, rule, or regulation.

• Investigate, remedy, or enforce potential Terms of Services violations.

• Protect the rights, property, and safety of us, our users, or others; or detect and resolve any fraud or security concerns.

• In the aggregate or after de-identification. We may also share with third parties, such as advertisers, aggregated or de-identified information that cannot reasonably be used to identify you.

You expressly agree that the information provided when you register the Platform and/or the content your created when using the Platform (including, without limitation, photos, text, messages, posts, html, URLs, pictures, video, and other content), may be recorded, stored, published and made available to the rest of Bora Live users. Furthermore, other users may follow you on the Platform, and your followers can see, for example, the user-contributed content that you have uploaded to the Platform. Individuals reading this information may use it or disclose it to other individuals or entities without our control and without your knowledge. We therefore urge you to think carefully about including any specific information you may deem private in the information you provided or content that you create in the Platform.

Your information may also be stored and process in any country in which we provide service to due to server facilities and third-party service teams. By using our service, you consent to any such transfer of information outside of your country.

If you do not agree with all the terms of this Privacy Policy, please do not use our service. Community safety is our number one priority and some of the above user information are mandatory in order to create a safe community for all users.

4. International Data Transfers

Your personal information may be processed by us and our trusted third-party service providers located outside the country or countries where you reside. This includes nations whose data protection and privacy laws or regulations may be equivalent to, or offer a similar level of protection as, those in your country of residence.

We run stress tests on our systems to help us improve. Access to all personally identifiable information is strictly restricted to Bora Live team, contractors, agents and Third-Party Partners and service providers who need to know that information in order to provide, operate, develop, maintain, support or improve the Service or otherwise carry out any of the purposes as set out in this Privacy Policy. Bora Live implements appropriate technical and physical security measures, such as using password protection, access logs, and system monitoring to maintain the confidentiality and security of all users' information against any loss or unauthorised disclosure, use and modification.

To ensure secure data transmission, all communications are encrypted via HTTPS protocol. For advertising optimization, we share anonymized usage data with Adjust, our trusted analytics partner. This collaboration enables us to accurate campaign performance measurement and improve marketing efficiency.

However, due to the inherent nature of the Internet and related technology, we do not guarantee the protection of information under our control against any loss, misuse or alteration.

Your information may be stored and processed in any country in which Bora Live or its service providers maintain facilities. In this regard, or for purposes of sharing or disclosing data as described in this Privacy Policy, Bora Live reserves the right to transfer information outside of your country. By using the Service, you consent to any such transfer of information outside of your country. We also process information about you across the Bora Live team for these purposes, as permitted by applicable law and in accordance with their terms and policies.

We may also pseudonymise or aggregate Personal Information for analytical purposes. This helps us develop new and improve existing services, conduct fraud detection and account safety analysis, analyse usage trends, and provide third party service providers with basic statistics about how their service is being used by Bora Live users.

6. Data retention

6.1 General Retention Policy

We retain personal data only:

• As required by applicable laws and regulations.

• For the minimum period necessary to fulfill the original processing purpose.

• Immediately initiate deletion procedures when the processing purpose is achieved or changes.

6.2 User-Submitted Information

All personal data voluntarily provided through feedback/consultation channels will be:

• Processed for immediate response.

• Permanently deleted after processing.

• Never retained, backed up, or shared with third parties.

6.3 Account Management

Upon account deletion/disablement requests:

• A 30-day grace period applies before permanent deletion.

• During this period, account recovery remains possible.

6.4 Messaging Data

Chat logs are automatically deleted after session termination, except when:

• Temporarily retained for security reviews (e.g., suspected policy violations).

• Retention never exceeds legally mandated investigation periods.

7. Your rights and choices

You can always control what information you choose to share with us on the App (except for information which we have indicated as mandatory for you to provide). To do so, you can change your settings in the App or in your mobile device. Alternatively, you can remove the App from your mobile device entirely.

You can choose to remove your data anytime you want. If you ask us to delete your account, we will use commercially reasonable efforts to remove your data from our servers, subject to any applicable legal or other requirement to maintain certain records of your personally identifiable data. Please note that the deletion of your personally identifiable data from our database may result in us not being able to provide you with the Service.

To delete your data please click within the App on Settings located in the top right corner of your profile > click on "Setting" > select the option "Delete Account" > click on "Delete Account."

7.1 GDPR Compliance (European Economic Area Users)

• Access Right: View all collected personal data (name, contact details, usage history, etc.) and access provided through clear data dashboards with direct query paths.

• Correction Right: Request updates to inaccurate information via support email ([email protected]); We will process it within 15 working days.

• Erasure Right: Request deletion of specific data or full account cancellation; Completed within legal limits (exceptions for regulatory/security requirements noted).

• Processing Restriction: Revoke app permissions (contacts/location/camera) anytime; Immediate cessation of new data collection (existing authorized data unaffected).

• Data Portability: Obtain personal data in structured formats (CSV/JSON); We will process it within 15 working days.

• Objection Right: Challenge data processing with legitimate grounds.

7.2 CCPA Compliance (California Residents)

• Knowledge Right: You have the right to request disclosure of collected data categories and usage purposes.

• Deletion Right: You have the right to delete personal data (exceptions: legal compliance/security records/backups), with denials explained.

• Opt-Out Right: You have the right to opt-out of third-party data sharing (we never sell data).

• Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.

8. Children Safety

Our service requires users to be at least 18 years of age. In the course of your use, we do not intentionally collect personal information, yet we may gather data on your age to ensure compliance with the usage standards of our application. If we become aware that we have inadvertently received or collected personally identifiable information from a user under the age of eighteen (18) as part of the Service, we will delete such information from our records. If you are under the age of eighteen (18), please do not use the Service.

Please note that as a parent or legal guardian, it is your responsibility to supervise and manage your child's use of our services. If a minor provides false information and claims to be of legal age, you, as the parent or guardian, will assume full responsibility for any consequences arising from such misrepresentation. We strongly encourage parents and guardians to educate their children about the importance of online safety and to monitor their activities to ensure compliance with our policies and applicable laws.

8.1 Bora Live has a zero-tolerance policy toward Child Sexual Exploitation and Abuse (CSEA) and any harm to minors. Violations will result in permanent bans, and severe cases will be reported to authorities. Do not:

• Send, request, or discuss sexually explicit content with a minor.

• Create servers for sexual interactions with minors or that give them access to sexual content.

• Groom, sextort, or attempt to meet a minor for sexual purposes.

8.2 How to Comply:

• Do not post child sexual abuse material—even as a joke.

• Do not exchange sexual content with anyone under 18.

• Leave servers that violate these rules.

8.3 We use automated systems and human review to detect CSEA and underage activity, analyzing registration, behavior, and content.

Report violations via the in-app feature, customer service, or email: [email protected]. Incidents involving minors will be reported to NCMEC and relevant authorities.

Violations lead to content removal, account suspension, or permanent bans. Severe cases are reported to law enforcement.
